TERMS & CONDITIONS

1. Welcome: By accessing and using our website, parkroadphoto.biz, and our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

2. Services: Provided Park Road Photo offers professional real estate photography & videography services, including interior & exterior photography & videography, virtual tours, & floor plans as described in our services.

3. Deliverables: We provide high-resolution digital images & videos, quantity/duration based on square footage unless otherwise agreed upon. Final edited photos will be delivered within two (2) business days following the photography session. Video will be provided within two (2) business days following the videography session. Virtual Tour can take up to one (1) week turnaround time.

4. Fees and Payment: Clients agree to pay the total quoted fee for our services. Payment terms, including deposits and final payments, must be completed as outlined in the service agreement.

5. Cancellations and Rescheduling: Cancellations should be made at least 24 hours in advance. If canceled within eight (8) hours of the scheduled session, any deposit paid will be non-refundable. Clients may request a reschedule, subject to availability.

6. Refund Policy All sales are final. Due to the nature of digital photography and the deliverables provided, Park Road Photo does not offer refunds once the final images have been delivered. Clients must pay in full before receiving their files. If there are any issues with the delivered images, we will work with the client to address reasonable concerns.

7. Rights and Usage: Park Road Photo grants clients an unlimited, perpetual, transferable, and exclusive right to use, reproduce, distribute, display, and modify the photographs for any lawful purpose, including commercial use, marketing, advertising, and social media. Clients may sell, license, or distribute the images to third parties without further consent or compensation to Park Road Photo.

8. Model Release: Unless otherwise stated in writing, the client grants Park Road Photo permission to use images for promotional purposes, including portfolios, website content, and social media.

9. Liability: Park Road Photo is not responsible for any property damage occurring during the photoshoot. Clients are responsible for securing permission from property owners for access and photography. We are not liable for failure to deliver images due to circumstances beyond our control (e.g., weather, technical issues, client non-cooperation).

10. Indemnification: Clients agree to indemnify and hold Park Road Photo harmless from any liability, damage, or loss arising from the use of the photographs.

11. Confidentiality: Both parties agree to maintain confidentiality regarding proprietary or confidential information shared during the engagement, including pricing, business strategies, and any private business information.

12. Dispute Resolution: In the event of a dispute, both parties agree to first attempt to resolve the issue amicably. If a resolution cannot be reached, the parties agree to mediation or binding arbitration before pursuing legal action.

13. Agreement: By using our website and services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These terms may be updated at any time, and continued use of our services constitutes acceptance of any changes.
